Self-determination and Trade
The right of peoples to self-determination is being eroded not only by the unsettled classic colonization and occupation, but also by the imposition of multi-national corporate trade authority created by State agreements. This is eroding the sovereignty and title of peoples to their territories through international trade agreements. Although current international standards should protect peoples against this subjugation, domination and exploitation, the imposition of corporate authority and of international trade agreements give precedence to transnational corporations and business enterprise to develop peoples’ territories without an implementable standard of protection against such encroachment. Article I of the Internationals Convention on Civil and Political Rights (ICCPR), the International Convention on Economic, Social and Cultural Rights (ICESCR) and other international instruments should take precedence, in practice, the legal systems give preference to State or corporate supported development projects that dispossess and displaces and destroy the habitat of many peoples, including Indigenous Peoples. This panel will give most of its focus on the studies and reports of Professor Alfred de Zayas, the Independent Expert on the Promotion of a Democratic and Equitable International Order and the impact of international trade agreements and their lack of protection of for developing countries and peoples.
